Who Are California Residents
If you are a California resident applying to, or already employed by, John Galt Staffing, Inc. or any of its affiliates (together, “John Galt” or the “Company”), this Notice describes the rights granted to you under the California Consumer Privacy Act of 2018, as modified by the California Privacy Rights Act (referred to together in this Notice as the “Privacy Act”).
In General
John Galt understands the importance of protecting the information candidates and employees provide us, as well as the information we receive from our third-party service providers and others about individuals utilizing our services. We therefore want to be clear about the information we collect as part of the recruitment process and how and why we use such information.
Our primary business purpose for collecting and using your personal information is to provide employment staffing services, which includes search, recruitment, screening and placement of candidates in temporary assignments and permanent jobs with our clients.
For all categories of personal information collected, we disclose personal information to our service providers and other third parties to help us accomplish our business purposes as described in this Notice and in our Privacy Policy, which Privacy Policy applies both to those who visit www.j-galt.com and any domains and affiliated websites and social media pages and applications (together, the “Site”), as well as those who interact directly with John Galt employees, agents and representatives. This Notice is provided as a supplement to our Privacy Policy and should be read in conjunction with such policy.
In general, “personal information” under the Privacy Act is information that identifies, relates to, describes or could reasonably be associated with or linked with you or your household. For example, it could include your name, social security number, email address, professional and employment information, criminal history, and inferences from other personal information that could create a profile about your preferences and characteristics. Generally speaking, the contents of job applications, employee personnel records, and employee communications are all considered personal information under the Privacy Act.
The information individuals provide to John Galt during the application and recruitment process is voluntary and can be limited or stopped at any time. Please note, however, that some of the information requested is mandatory, such as name and contact information. If you decide not to provide required information, John Galt likely will not be able to consider you for employment.
Candidates and employees are responsible for the information provided, including its accuracy and completeness.
Types of Personal Information We May Collect
Below is a non-exhaustive list of the types of personal information we collect:
- Personal identifiers and contact information, including name, postal address, email address, telephone number, IP address, date of birth and Social Security number
- Employment information, including prior employers, work experience, dates of employment and job descriptions
- Educational information, including school(s) attended, dates of attendance, grades/transcripts, degree(s) and educational and academic achievements
- Background information, including criminal history, driving record, credit history, drug screening, military service, SSN verification and residential history
- Work authorization/eligibility
- Non-competition, non-solicitation and similar restrictions on employment
- Character and reputational information
- Job or role-specific information, including skills and proficiencies, qualifications and certifications, licenses, desired compensation and benefits, full or part time, and location
- Job interview information, including availability and feedback
- Benefits information, including health insurance elections, voluntary insurance and benefit options, beneficiaries and dependents, and retirement plan contributions and vesting information
- Financial information, including bank account information, exemptions and deductions, contributions, and wage and hour and payroll records
- Protected characteristics/EEO information, including gender, race/ethnicity, disability status, and veteran status
- Emergency contact information
- Accident and workers’ compensation claim history
- Other personnel information, including performance reviews and evaluations, disciplinary history, and travel records
- COVID information, including vaccinations records, exemption request documentation, and diagnoses
- Electronics use, including telephone, computer, Internet, network and other devices, applications and systems
- Inferences and information drawn from the above, including interest expressed in obtaining services based on email request or feedback
Sources of Personal Information We May Collect
We primarily collect information from individuals looking to utilize our services, whether it is via a visit to the Site or a job board, their résumé or CV, interactions with Company employees (such as screening calls and interviews), and a candidate’s provision of requested documentation. The non-exhaustive list below includes the other typical sources of personal information collected:
- Third-party vendors such as background check companies and drug testing/screening facilities
- Employers (current and former)
- Educational institutions
- Law enforcement agencies
- Government agencies (foreign, state and local), including the Department of Defense and Social Security Administration and state motor vehicle agencies
- Credit bureaus and consumer reporting agencies
- Landlords
- Personal contacts and professional references
- Licensing authorities (public and private)
- Client-provided information
- Insurers and benefits providers
- Banks and other financial institutions
- Employer-provided information
- Workers’ compensation insurers and agencies
- Health care providers
- Other third-party service providers and advertisers
Purposes of Personal Information We May Collect
As noted above, the primary purpose for which we collect personal information from individuals is to provide employment and staffing services, which includes determining candidates’ suitability for assignments and jobs. In addition, we list below the other business or commercial purposes for which we may use personal information:
- Contact and communication purposes, including placement decisions and employment-related matters, including communication with family members and others in the event of an emergency
- Identity verification
- Employment verification
- Education verification
- Reference verification
- Compliance with law and contractual requirements, including insurance policies
- Administration, management and maintenance of insurance and benefit programs and plans
- Management and processing of payroll
- Tax withholding
- Attainment of diversity, equity and inclusion goals
- Management of workers’ compensation claims, and administration of workers’ compensation program and related insurance policies
- Evaluation of employees for hiring, promotion, demotion, transfer, discipline, termination and other employment actions
- Conduct of workplace investigations
- Compliance with Company and customer vaccination requirements and management of exemption requests
- Contract tracing and communication with close contacts about exposure
- Implement, monitor and manage electronic security measures
- Detect security incidents
- Monitor employee movement and activity in Company facilities
- Marketing
- Analytics and research
- Customer service and support
- Product/service improvement and development
Personal information does not include publicly available information contained in government records, deidentified or aggregated consumer information, and information excluded from the Privacy Act’s scope such as health or medical information covered by the Health Insurance Portability and Accountability Act and personal information covered by sector-specific privacy laws like the Gramm-Leach-Bliley Act.
In all cases, we may use personal information to comply with applicable law or respond to legal process, respond to requests from public and governmental authorities, and in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or equity (including in connection with any bankruptcy or similar proceedings).
John Galt does not require or request:
- Sensitive personal data or personal information – such as medical history, height, weight, religion, biometric or genetic data, or political beliefs – as part of our recruiting and candidate selection. If you have a disability and would like John Galt or permanent employers to consider an accommodation, you may provide that information during the recruitment process.
- Commercial information.
- Sensory data.
To the extent you do provide sensitive personal data or personal information, you expressly authorize John Galt to process and use such information in accordance with this Notice, our Privacy Policy and applicable law.
Once information is collected, we create a candidate profile to reference for current and future employment opportunities. Each profile is saved in our candidate database.
Use of Automated Tools
John Galt’s recruiters may perform searches against our applicant database using automated tools to target relevant job requirements and match them against an applicant’s credentials. Candidates may be asked to successfully complete tests, such as coding challenges for software developers, that are relevant to the role, and such testing may make use of automated tools. However, employment decisions are not based solely on the use or outcome of automated processes.
Who is Given Access
John Galt may share information collected from and about candidates and employees within its own corporate family and with authorized third parties who play a role in John Galt’s recruitment and placement services, such as background check companies, benefits providers and administrators, and prospective employers. Those who are granted such access must have a legitimate business purpose for such access, and John Galt shares only the information necessary for the performance of that specific purpose.
As a condition to employment, most candidates will be subject to pre-employment screening. The type of screening will depend on the assignment/job and client. Screening are conducted to verify educational history, employment history, professional qualifications and certifications, criminal history (which may include driving record), and/or work eligibility, among other purposes. Drug screening also may be required and will depend on job type, client requirement, and applicable law.
John Galt relies on third party service providers to conduct such pre-employment screenings and will release identifying information to such providers to enable their work. Candidates are advised of this requirement and consent is obtained to perform such screenings. Consent is also obtained to share the results of such screenings with those at John Galt and our clients with a need to know in order to fill a temporary assignment or place an individual in a permanent position.
Your consent to pre-employment screenings and the sharing of such information with others may be revoked at any time. Note that the revocation of consent may impact our ability to assess your candidacy and/or hire or place you.
Sale
In the preceding 12 months, John Galt has not sold any personal information. In the event John Galt was to begin selling personal information as part of its business, we will become subject to the requirement to provide a clear and conspicuous “Do Not Sell My Personal Information” link on our Site that allows you to submit an opt-out request (see below). You are not required to create an account in order to submit your request.

Retention of Information
If you are offered and accept employment at John Galt, the information collected about you during the application and recruitment process will become part of your personnel record and will be kept in accordance with our policies for retention of employee data.
If your application is unsuccessful, we will retain your personal information on file to consider you for other job opportunities for a period of 3 years, unless a longer period is required to comply with our legal obligations and resolve any disputes regarding the recruitment and selection process.
Our Privacy Policy and Your Privacy Act Rights
This Notice contains information required by the Privacy Act and supplements our Privacy Policy, which can be found here: John Galt Privacy Policy. Our Privacy Policy explains your rights under the Privacy Act, which include the right to correct or request that we delete information collected about you.
